Amending Dane County Subdivision Ordinance

Summary:

Earlier in 2003, the Court of Appeals issued its decision in Rogers Development, Inc. vs. Rock County.  In that case, the Court held that the counties lack authority to impose standards for required public improvements under their subdivision ordinances.  As a result, the county has proposed modifications to its subdivision ordinances to delete requirements that the county believes it no longer has the authority to enforce. 

 

Arguments Pro:

Responds to the Rogers decision by deleting ordinance requirements that no longer apply.

 

Arguments Con:

It would appear that there is no alternative to repealing these provisions; towns which may have to confront these public improvement issues should adopt their own ordinances to make sure those standards exist.

 

Recommendation:

Support OA-20.
